In the eyes of the law, a person can be “under the influence” or “impaired” by alcohol, drugs, a combination of both, or multiple types of drugs. If you elected to take the intoximeter test and the result was over 0.08, you may also be facing a charge of Driving Under the Influence Per Se, since the test shows you are over the “legal limit” of alcohol you can have in your system, according to Maryland law.
The greater charge is Driving Under the Influence, which carries a maximum term of one year imprisonment and/or a $1000 fine, if it is a first-time offense. The lesser charge is Driving While Impaired, which carries a maximum term of 60 days and/or $500 fine, if it is a first-time offense. Typically, if you are charged with drunk driving, you will be charged with both Driving Under the Influence and Driving While Impaired, as well as other charges. Additional charges may result if you were in an accident, if anyone was hurt, or if there were minors in your vehicle at the time of the offense.
If this is not your first conviction of Driving Under the Influence or Driving While Impaired, then the State may seek Subsequent Offender Penalties, or in other words, a higher punishment. The amount of imprisonment or fines can vary based on your prior record, but needless to say, the seriousness of your situation increases exponentially.
In regards to your license, many things can affect your privilege to drive.
